Abstract
This article focuses on the question o legality in the framework of the constitutive and subsequent judicial review in the production of investigative actions, limiting constitutional rights and freedoms. It analyzes the need to introduce a legislative ban on the consideration of the merits of the case by the judge who had previously exercised judicial control.
