Abstract
The article deals with the problem of the death penalty in the Russian justice, based on the Orthodox perception of crime as a sin, as criminal - as a sinner, encroached on the «symphony of powers» and social harmony, and thus deserving of special cases, eliminating it from the earthly existence. The author emphasizes the weakness of positions both supporters and opponents of the death penalty, denied a sectoral ideologically biased in and utilitarian approaches to the problem and concludes that the need for a comprehensive scientific study of the problem in historical and philosophical and religious-philosophical context.
