Abstract
The article deals with the jurisprudence on the implementation of the public prosecutor office under Art. 221 Code of Criminal Procedure. The authors criticize the practice of recognizing insignificant violation of the law the investigator returned the case without issuing a written decision with the oral instructions. Revealed the legal position of the Armed Forces of the possibility of applying by analogy the provisions of Article 3 of Part 1. 221 Code of Criminal Procedure in the event of a criminal case to the prosecutor with the indictment.
