AbstractThis article is dedicated to researching of the legal essence of the institute of consular protection. Legal nature of any institution of law is fundamental, internal and stable characteristics, which reflects its nature and purpose in the community. Revealing the essence of the institute of consular protection is based on the study of social values and ideas that define the character of law. Legal nature of the institute of consular protection is characterized by its role in society, service to the interests of all people without exception, providing the organization, stability, and strengthening the international and social communications.
The idea of the legal nature of the institute of consular protection of citizens' rights, is possible to continue with the view that human rights function defines the core of all activities of the consul, being the regulator of the rights and interests of citizens abroad.
Consular protection of citizens' rights abroad strengthens human rights protection functions of the state towards its citizens. Thus, consular protection is not just a mechanical process, but also a guarantee of the freedom of people.
